Digi Power X, a company that builds data centers and energy infrastructure, is facing a proposed class action lawsuit due to alleged noise pollution at its cryptocurrency mining facility in North Tonawanda, New York. The lawsuit was submitted to the US District Court for the Western District of New York by residents Sharon Demers, Karen Hance, Mark Polito, and other locals from the area.
The complaint claims that the mining activities conducted by Digi Power X at 1070 Erie Avenue have exposed nearby residents to persistent industrial noise and low-frequency vibrations generated by cooling fans and other mining equipment. The plaintiffs assert that these mining operations have led to ‘significant annoyance, emotional distress, loss of comfort and enjoyment, depreciation in the value of their property, and heightened risk of adverse health impacts.’ The lawsuit aims to obtain financial compensation, a court order to stop the noise, additional penalties, and a healthcare monitoring system for people who reside near the source of the noise, which they claim has been causing continuous disturbances for about four years, according to a news report from WKBW.
A neighbor named John Helmer expressed to the news source, “The noise is quite loud, causing my wife to awaken during the night.” It occurs each day. Every evening. It doesn’t stop.”.
Digi Power X, previously called Digihost Technology, is involved in the creation and management of energy and digital infrastructure assets. Their portfolio includes Bitcoin mining infrastructure and AI-equipped data centers. The North Tonawanda facility is a repurposed Fortistar gas-powered peaker plant.
