Several environmental nonprofits are threatening to sue Vantage Data Centers and VoltaGrid over two planned natural gas-powered off-grid data center projects just outside San Antonio, Texas.. – VoltaGrid. The Environmental Integrity Project, the Sierra Club, and Public Citizen contended that the companies circumvented environmental regulations by failing to secure the necessary permits for the campus and on-site generation assets..
According to the notice of intent to sue letter, the companies argued that the on-site generation, comprising two gas-fired power plants with a combined capacity of 423MW and 151 diesel backup generators with a capacity of 454MW, posed “a serious public health threat.”. The letter contends that the companies claimed that the generation assets are “not major sources of pollution,” and instead obtained “minor” source permits from the Texas Center for Environmental Quality (TCEQ)..
It went on to claim that the companies did this by claiming that each data center and co-located power plant at each location is a separate source of pollutants that purportedly fall below major-source thresholds. In addition, it points out that there was no opportunity for public notice or participation regarding the issuance of the minor source permits..
The letter states that if the two companies fail to “resolve the noticed violations within 60-days of issuance of this letter, or the United States Environmental Protection Agency or the State of Texas fails to take action sufficient to fully resolve the violations, Citizens will file suit in the United States District Court for the Western District of Texas to compel compliance with the Clean Air Act and stop the ongoing harm suffered by Citizens and their members.”. Vantage and Volta partnered last February to deploy 1GW of off-grid natural gas generation across its North American portfolio.
